Article 4 direction

Article 4 direction is a type of planning permission that can be used to control development in conservation areas. These type of directions are made by the local planning authority and can be used to control developments that would normally not require planning permission, such as changes to windows or doors. They can also be used to control developments that would normally require planning permission, such as extensions or lofts conversions.

Local planning authorities make and manage these type of directions in order to restrict the scope of permitted development in any one area or site.

Why Are They Required

These directions are made in order to protect the special character and appearance of conservation areas from development that would undermine their significance. These typically and usually have the effect of making it more difficult to carry out certain types of development within conservation areas.

Who Controls Them

The Local planning authority is fully responsible for creating and maintaining Article 4 directions which aim to protect historical and or conservation areas. This means that if such a direction is in place for the area or site you wish to develop or make changes to then you will always need to apply for planning.

Does It Affect Me

If you live in a conservation area and want to carry out any development that could be affected by this type of legislation, you should contact your local planning authority to check whether or not a direction has been made.

What Do I Need To Do

Firstly, if you are planning on changing a property usage and or any physical developments then you should always check with your local authority to find out if there has been an Article 4 issued. By doing this you can ensure that no work is carried out that may have to be undone if there is a direction in place.
